Unauthorized use, including hacking or misuse, will result in immediate account termination without a refund.
We reserve the right to take legal action against any unauthorized use.

5. Intellectual Property

All content, designs, software, and materials provided by ToHost remain our property.
You may not copy, distribute, modify, or create derivative works without our written consent.
Unauthorized use of our Platform or Services may result in legal action.

6. Payment and Refunds

6.1 Payment Obligations

You agree to pay all applicable fees for Services purchased.
Payments must be made per the terms specified during purchase.

6.2 Refund Policy

Refunds will be processed only if the requested Service cannot be delivered as per our policies.
No refunds will be issued for violations of these Terms, including prohibited activities.
Chargebacks, disputes, or fraudulent transactions may result in account suspension or legal action.

7. Prohibited Content and Activities

7.1 Prohibited Content

You may not host, distribute, or engage in activities involving:

Illegal material, copyright violations, pirated content.
Adult content, pornography, or nudity-related content.
Spam, unsolicited emails, mailing lists, or bulk emailing.
Hacking tools, warez, or exploits.

7.2 Prohibited Hosting Activities

IRC scripts, proxy scripts, or torrents.
Streaming services on shared or reseller hosting plans.
Violations will result in immediate suspension or termination without refund.

8. Mailing Policy

Each cPanel account may send up to 1,000 emails per day.
Bulk emailing is strictly prohibited on shared and reseller hosting plans.
Accounts sending spam will be suspended without notice.

9. Data Backup and Security

Customers are solely responsible for maintaining data backups.
ToHost is not liable for data loss, unauthorized access, or hacking incidents.
Customers must regularly update scripts, plugins, and modules to maintain security.

10. Domain Registration Policy

You may not register domain names that infringe on trademarks or copyrights, including but not limited to:

amazonaffiliates.in
facebookfollower.in
googleindia.in

Violations may result in deletion of the domain without refund.

11. Resource Usage Limits

CPU, RAM, Bandwidth: Excessive usage may result in suspension or throttling.
Inode Limits: Shared hosting accounts have inode limits; exceeding them may result in restrictions.
Fair Usage Policy: Customers must comply with fair usage limits for CPU, disk, and bandwidth.

12. Force Majeure

Neither party shall be liable for failure to perform obligations if prevented due to:

Natural disasters
Power outages
Government actions
Circumstances beyond reasonable control

13. Indemnification

You agree to indemnify and hold harmless ToHost, Pixgator Services (OPC) Private Limited, its affiliates, officers, directors, agents, and employees from any claims, demands, or legal actions arising from:

Your breach of these Terms.
Your violation of laws or third-party rights.
Any penalties imposed due to your actions.

14. Limitation of Liability

ToHost shall not be liable for:

Indirect, consequential, incidental, special, or punitive damages.
Loss of profits, revenues, business, or data.
Any claims exceeding the amount you paid for the Service or ₹100 INR, whichever is lower.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Aligarh, Uttar Pradesh, India.

16. Amendments

We may modify these Terms at any time. Changes take effect immediately upon posting on our website.

Please note that you may be able to browse certain sections of the Platform without registering with us.We do not offer any product/service under this Platform outside India and your personal data will primarily be stored and processed in India. We may in event of any pending grievance, claims, pending shipments or any other services we may refuse or delay deletion of the account. Once the account is deleted, you will lose access to the account.
